1.2 Please read these Terms carefully before using the Marketplace. They detail who we are, how we operate the Marketplace, your rights and obligations, and other key legal information.

1.3 In addition to these Terms, you agree to the:

    All Auctions are governed by The Laws Of England and Wales, should an auction take place outside of England & Wales, the laws of that specific country or demographic will apply.

All Sales are final and legally binding, buy bidding and subsequently Winning an auction you have agreed to these terms and conditions of sale. Should you encounter during a collection an item(s) deemed as Illegal under the laws of that specific area, you are to stop the collection at that point and inform the site manager(s) of what has been found, should you be already loaded good(s) we will insist that you check all the items loaded should more illegal items be found, for example - Should you find a firearm or drugs. The site manager will report this back to us & you are of the understanding, that the sale was final and you have no recourse back to both us "byabandoned.com" or the seller. The Seller will make a final decision as to what the next steps are and you will receive further instructions from them. In regards to everything else as already mentioned all sales are final, we do not or our sellers accept any returns at all, once you have signed the relevant documents which will include but not limited to a waste transfer note and contract of sale, the goods are then yours and you must proceed to clear the space and once completed you will receive if any your deposit which is to be paid to the site manager or member of their team, which will be returned to you once the space has been checked and signed off being totally clear and ready for the next tenant. We do not do a soft close on our auctions nor do we extend the time of the auction, when the auction has counted down the time, the auction will be closed and awarded to the winning bidder, at that point we will ask that you make a payment to us in order to finalise the transaction. Once cleared funds have been received you will receive an email with further instructions as to the next steps, this will also include the name, address, telephone number, email address, your contact on site & if available a whats app number. We would then ask that you make contact with the relevant site managers within 24 hours as to arrange a date and time which will be your rough ETA (Estimated Time Of Arrival) to the location of your winning lot. Should however you choose a postal or pallet delivery (which is at an extra cost) we will arrange for the item(s) to be bundled, boxed & shipped, by taking this option you have indemnified us buyabanoned.com & the seller against any damages or such like, while every effort is taken to ensure the goods arrive with you safely and as per the pictures of the items that you have won in an auction. Our staff are highly trained professionals with many years of experience who are always on hand to help and answer any questions that you may have. Please note that we do not use a specific courier and we will make every effort to ensure we get the best price for your delivery, we do not make anything on postal services. Please note that if a lot costs £1 or £1,000,000 all items are treated in the same way therefore we use a fully insured, tracked and signed for service. We will only ship goods to the address which has been registered to your account, therefore we would kindly ask that you ensure on a monthly/weekly basis that all of your details are correct as if you ask for the winning lot to be sent to anywhere outside of your address which is registered with us, the transaction could be cancelled without any refund due to you, we deal with this on a case by case basis like we do with any other situation/issue that may arise. If you have taken a platinum membership you will invited (subject to numbers) to an open outcry auction (an auction that takes place on site), should you be invited you will receive an email with the date and location of this auction which we would kindly ask that you reply to within 24 hours of receiving the email, instructions will be given at the time and will be on a first comes first serve subject to the numbers allowed by the relevant site manager, should you accept the invitation and not be successful on that specific occasion you will be placed on our waiting list and as soon as more auctions of this type happens, you will be invited to all until you have selected an auction that works for you. There maybe an occasion where filming takes place for social media/TV etc. you will be asked within the email sent if you agree to be filmed or not, should you agree you will have to sign a waiver/release form which is standard industry procedures. If you would like to be ahead of the game please use a contact us form with your request, locations preferred and any dates you cant do. THIS IS ONLY AVAILABLE TO ONLY PLATINUM MEMBERS, outside of this there are many other benefits available to both Gold & Platinum Members, these may vary from time to time and special events/updates and offers will be available for you to take advantage of. If you are collecting the goods please ensure you have on hand the cleaning deposit as stipulated by the relevant site, you will also be required to provide a physical official Government issued (passport, driving licence (not a provisional), ID Card (if not a UK National) this will be photocopied by the site and kept on there files. If you are located outside of the UK and would like the won item(s) to be sent to you, we will make every effort to ensure you get the best possible price, you are of course welcome to arrange your own couriers which if that is the case please advise us as soon as possible so that we can provide vital information such dimensions and estimate weight. you may be subject to local taxes which can not be paid for buy us and you will bear the cost of these taxes should import/export duty and VAT in the final destination of the goods.

3. Registering an Account

3.1 You must be at least 18 years old and complete the registration process to use the Marketplace as a buyer.

3.2 By placing a bid or listing an item, you waive your 14-day cancellation right under the Consumer Contracts Regulations.

3.3 Registration requires personal and payment details to verify your identity.

3.4 We reserve the right to reject or suspend any account application.

3.5 You must keep your login details confidential. Notify us immediately if you suspect unauthorized access.

3.6 Misuse of the platform (fraud, harm, etc.) will result in account suspension or termination.

5. Access to the Marketplace

5.1 Sellers may list items once their application is approved.

5.2 Listings may be refused at our discretion.

5.3 Seller fees are specified in Appendix 2.

5.4 There is no charge to buyers unless stated otherwise.

5.5 The seller is responsible for accurate listings. Our checks do not guarantee accuracy.

5.6 Sellers may remove listings at any time.

5.7 Seller terms in listings may differ; you must read and agree to both.

5.8 Winning buyers must pay a security deposit (if applicable) upon collection.

5.9 Failure to remove all items or forfeiture of deposit may result in account suspension.

5.10 We are not liable for delays outside our control.

5.11 We do not guarantee the continuous availability of the Marketplace.

6. Listing an Item (Sellers)

6.1 Items must be located in Canada during listing and sale.

6.2 Auction processes are governed by the Auction Rules (Appendix 1).

6.3 You confirm ownership or authority to sell the item.

6.4 Listings must include:

• Accurate descriptions;

• Detailed condition reports;

• Clear photographs.

6.5 We reserve the right to reject listings without explanation.

6.6 Listings are exclusive. Offering the item elsewhere breaches our terms.

6.7 If the buyer fails to collect, we may offer to under-bidders.

6.8 Self-bidding or encouraging artificial bidding is prohibited.

7. Buying Items (Buyers)

7.1 Bids are irrevocable offers. Winning bidders are legally bound to purchase.

7.2 We may remove a bid if:

• It was a mistake;

• The payment card is invalid.

• Suspicious bidding activity is detected.

7.3 After a win, the buyer and seller’s contact details will be exchanged. The transaction must be completed within 7 days.

7.4 Failure to complete the purchase results in account suspension.

7.5 Off-platform purchases are prohibited. We may charge seller fees if this occurs.

8. User Content

8.1 The Marketplace includes content from users. We do not guarantee accuracy.

8.2 Content must not:

• Be defamatory, illegal, offensive, deceptive, or infringing;

• Violate privacy or cause harm.

8.3 You warrant you own all rights in your content and indemnify us for any breach.

8.4 We may remove or disclose your content without notice if it violates these Terms.

8.5 You grant us a royalty-free, global license to use your content.

8.6 You must not misuse or copy our platform’s content.

9. Cancelling Your Agreement With Us

9.1 You may cancel your agreement with us within 14 days unless you bid or list during that period.

10. Termination by Us

10.1 We may suspend or terminate your account if:

• You fail to complete a purchase;

• You provide false or incomplete information;

• You cancel bids or listings improperly.

10.2 You may be liable for fees or damages upon termination.

10.3 We may remove listings without liability.

11. Mutual Cancellations Between Buyer and Seller

If the buyer and seller mutually agree to cancel a transaction, our seller fee still applies.

12. Disputes Between Users

We are not responsible for disputes between buyers and sellers. Resolution must be handled between the parties.

13. Limitation of Liability

13.1 Consumers must not use the Marketplace for business purposes.

13.2 We are not liable for:

• Loss of profits or revenue;

• Business interruption;

• Indirect or consequential losses.

13.3 Our total liability is limited to the amount of any fee paid to us.
